JAMMU, Aug 19: In a case of illegal mutation of the land title, Anti-Corruption Bureau has booked then Naib Tehsildar Katra, then Executive Officer and President of Municipal Committee Katra, besides others and seized incriminating material as documentary evidences after conducting searches.
Case FIR No. 02/2020 P/S ACB has been registered in ACB Udhampur-Reasi Wing, under section 5(1)(d) r/w Sec 5(2) of J&K PC Act Svt 2006 and Section 120-B RPC on the prima facie establishment of offences against Nek Ram, the Naib Tehsildar Katra; Ravi Kumar, then EO, Municipal Committee Katra ; Ashwani Kumar, then Inspector MC Katra; Mulkh Raj Sharma, then President MC Katra, Jugal Kishore , son of Nathu Ram of Jaganu, Udhampur; Sat Pal of Jhajjar Kotli, Jammu and Kailash Nath Pangotra of Trikuta Nagar, Jammu.
The case was registered in pursuance to a Preliminary Enquiry (PE) conducted by ACB regarding the role of the officers/officials of MC Katra and Revenue Department Katra by virtue of which a commercial superstructure had been erected on a State land situated in Katra town by one Satpal in violation to the provisions of J&K Control of Building Operation Act (COBA), 1988.
The PE revealed that piece of land in question was allotted to one Fazlu under a scheme to rehabilitate the landless downtrodden community of “Khakrobes” but the ownership rights were never conferred upon him and therefore he could not sell the land to any person. However, in the year 1999, the then Naib Tehsildar Nek Ram without any legal justification changed entries with respect to the said land in Khasra Girdawari register and entered name of one Jugal Kishore who subsequently raised double storeyed superstructure over the said land without obtaining building permission from the MC Katra. It has also been found that on 22-03-2006, Jugal Kishore sold the said piece of land along with the erected structure to one Sat Paul of Jhajjar Kotli and Kailas Nath Pangotra of Trikuta Nagar Jammu for consideration of Rs 11 lakh through an agreement to sell even as no change was effected in the revenue records in favour of Sat Paul and Kailash Nath.
Ironically, notices in connection with the illegal construction were issued by Municipal Committee Katra clandestinely in the name of one Ashok Kumar son of Bodh Raj of W. No.1, Katra. These notices were never served to the addressee in person but were pasted over under construction building and after expiry of stipulated period no action whatsoever was taken against the violators.
As such, case has been registered by ACB and further investigation is going on.
