Administrative Council re-constituted

JAMMU, Sept 5: In view of new Business Rules promulgated by the Union Ministry of Home Affairs for Jammu and Kashmir, the Union Territory Government has reconstituted the Administrative Council and assigned powers of Ministers to the Chief Secretary and various Administrative Secretaries.

As per an official order issued today by the Government today, the Lieutenant Governor will be Chairman of the Administrative Council while his Advisors will be the Members.
The Chief Secretary will function as Secretary to the Administrative Council.
The Administrative Secretaries of Finance, Planning, Development & Monitoring, General Administration, Law, Justice and Parliamentary Affairs or any other Department may be invited to meetings of the Council, if required, the order said.

The Chief Secretary, who will have powers of the Minister, will approve cases relating to accord of administrative approval to all kind of works/projects under plan/non-plan costing over Rs 7.5 crore up to Rs 20 crore with the concurrence of Planning.
He will also have powers for funds authorization in cases under Centrally Sponsored Schemes/Central Mega Flagship Schemes/TFC grants/Plan Scheme having financial implication above Rs 50 crore in each case.

Among others, the Chief Secretary will also have powers for opening of treasuries/sub treasuries with concurrence of the Finance Department, cases of exemption under GST and Toll Tax and purchase of new vehicles.
“The Chief Secretary will also have powers for transfer, posting and adjustment of Government officers up to and including Time Scale of Jammu and Kashmir Administrative Services (Deputy Secretary) and equivalent administered by the GAD in case of mature stay. In case of premature transfers, he will have the powers up to the Under Secretaries and equivalent levels,” as per the Government order.
He has been empowered to sanction deputation of officers of the level of Secretaries and above or equivalent for Government business/training outside the Union Territory but within the country. He will also approve departmental Recruitment Rules in both gazetted and non-gazetted categories after clearance by the designated departments.
The Administrative Secretaries will have powers to approve individual works up to the cost of Rs 7.5 crore and release funds authorized by the Finance Department in favour of Departments under their administrative control. They have also been empowered to sanction advance drawls up to Rs 25 lakh.
The Administrative Secretary GAD will sanction pensions of officers and officials subordinate to the GAD and leave up to the level of Special Secretaries. He will also have powers to order transfers/postings/adjustments of Under Secretaries, Administrative Officers, Private Secretaries and equivalent.
The Administrative Secretary, Planning, Development and Monitoring Department will have powers of Ministers in conveying results of project appraisal to Department and re-appropriation of funds for ongoing schemes under Border Area Development Programme (BADP).
The Administrative Secretary Finance Department who too will have powers of the Minister has been authorized to contact all open marks borrowings as approved in the Scheme of Financing for Annual Plan 2020-21 and subsequent years. He will provide temporary liquidity mismatch by taking the Over Draft route with Jammu and Kashmir Bank under RBI’s Ways and Means Facility within the permissible limit.
He will authorize funds under Centrally Sponsored Schemes and other schemes up to a monetary limit of Rs 50 crore in each case.
The Administrative Secretary Higher Education Department will be eligible to release grant-in-aid to Universities/Colleges and other institutions, give NOC for establishment of private colleges and institutions of Higher/Technical Education or addition of course and release National Service Scheme Grants to the Universities.
The Administrative Secretary Department of Food, Civil Supplies and Consumer Affairs will issue licenses of retail fair price shop and retail kerosene oil under the approved policy.
The Administrative Secretary Labour and Employment Department will sanction medical reimbursement claims under the ESI Schemes up to an amount of Rs 2 lakh in each case.
The Administrative Secretary School Education Department will deal with all issues of implementation of Samagra Shiksha and other Centrally Sponsored Schemes and Mid-Day Meal Scheme for school going children up to the level of 8th standard.
The Administrative Secretary, Department of Law, Justice and Parliament Affairs has been empowered to file appeals and LPAs and sanction all kind of counsel fee up to Rs 50,000 in the cases before the High Court.
