NEW DELHI, May 24: A Delhi court today discharged 13 city police personnel, including three sub inspectors, accused of gunning down a suspected gangster in an alleged fake encounter in 2002.
Chief Metropolitan Magistrate Vinod Yadav discharged the policemen of Special Staff (East District) after finding that no case was made out against them and they had performed their duty in good faith.
“This court is of the considered opinion that the cognisance against the accused persons in this case cannot be taken. They are accordingly discharged from this case,” the CMM said while accepting the closure report filed by the CBI in the matter.
The policemen had been accused of conspiring and murdering alleged gangster Rupender and also of destroying the evidence in the case.
The court discharged sub inspectors Vinay Tyagi, Atul Tyagi and Satish Rana, head constables Satinder Singh, Neeraj Kumar and Nagender and constables Prem Pal Singh, Raj Kumar, Hari Om, Naresh Pal, Sudhir Kumar, Rustam Ahmed and Upender.
The court in its 77-page order also pointed out various loop holes in the CBI’s probe into the matter.
On January 11, 2002, a Delhi police team led by SI Vinay Tyagi had conducted a raid on the residence of Rupender alias Kanu Jat at Pandav Nagar in East Delhi and had allegedly killed him in the ensuing encounter.
Investigation into the encounter was entrusted to the CBI after Kanu Jat’s father accused the police of killing him allegedly in a fake encounter. The CBI had registered the case in 2003 and had filed a closure report in 2008. (PTI)
