HC restrains Army from expansion of slaughter house

JAMMU, May 24: In a petition filed by residents of village Muthi seeking directions to the State functionaries to demolish/ remove the existing slaughter house at Muthi, which has been constructed illegally by Infantry Brigade against the provisions of Land Grants Act and Agrarian Reforms Act, the State High Court today restrained Army from expansion of slaughter house.
Advocate Nitin Bhasin appearing for the petitioners submitted that slaughter house at village Muthi has been causing nuisance, pollution, health hazards and inconvenience to the petitioners. He further submitted that Commanding Officer 19 Infantry Brigade without proper acquisition of land and without any permission/ license from the competent authority including Panchayat Muthi or the district administration, has constructed a slaughter house on agricultural land and changed the nature of the land in violation of Provisions of Land Grants Act.
After hearing Advocate Nitin Bhasin appearing for the petitioners, Justice Hasnain Massodi issued notice to State through Chief Secretary, Commissioner Secretary Revenue, Divisional Commissioner Jammu, Deputy Commissioner Jammu, Regional Director State Pollution Control Board, Union of India through Ministry of Defence and Commanding Officer 19 Infantry Brigade. In the meantime, Court ordered that Commanding Officer may operate the existing slaughter house at Muthi but expansion should not be made till next date of hearing.
