Bail denied to accused booked under ULA Prevention Act

JAMMU, Dec 9: Special Judge (Designated Court under NIA) Anantnag Khalil Ahmad Choudhary has denied bail to a person booked under Unlawful Activities (Prevention) Act.
The accused namely Waseem Ahmed Wani, son of Mohammad Akram Wani of Zainpora was arrested by Shopian Police on the ground that he was involved in heinous offence against the sovereignty and integrity of the country. Moreover, he was threat to the social fabric and law and order in the area.
After hearing the counsel for the accused and Public Prosecutor, the court observed, “there are reasonable grounds to believe that the allegations against the accused are prima-facie credible and plausible”, adding “the investigating agency is in the process of collecting further evidence to scan and analyze the involvement of the accused in the commission of crime imputed to him”.
“Fundamental right to individual liberty is certainly valuable but when it is pitted against the life and liberty of the people at large it becomes insignificant”, court said, adding “parameters to be adopted in the matter of considering the pleas of bail would be different in these cases and a strict approach in the latter category of cases is justified”.
“On over all analysis of the matter in its totality, I am of the considered opinion that at this stage there appear a reasonable ground for believing that accusation alleged against the applicant/accused is prima-facie true”, the court said and accordingly dismissed the bail application.
