Bail rejected in theft & forgery case

JAMMU, Dec 28: JMIC Bishnah Ananta Raina rejected the bail application of an accused involved in theft of vehicles and fraud case in Bishnah area of Jammu.
The accused identified as Deepak Kumar son of Yashpaul of R S Pura (district Jammu) was booked by police station Bishnah in case FIR Number 176/2020 under Section 379, 467, 468, 471, 411, 120-B IPC.
Advocate Dharam veer appearing on behalf of the accused submitted before the court that applicant is an innocent person and has committed no offence nor involved in the commission of any offence and Bishnah police has registered a false and frivolous case against him.
On the other side, APP Pawan Preet Singh appearing on behalf of Union Territory submitted before the court that accused is a habitual offender and involved in many other FIR’s relating to theft. “Moreover in non bailable and serious offences accused cannot claim bail as a matter of right,” he said, adding, the graph of crime relating to fraud with respect to motor vehicles is increasing at an alarming rate and enlarging accused on bail shall give adverse message to the society.
The court after hearing both the sides observed that there is prima facie involvement of the accused in the crime. Observing further that the offences are serious and enlarging accused on bail at this stage will not be in the public interest, the court rejected the bail application of the accused.
