HC denies anticipatory bail to accused employees

Srinagar, Dec 30: High Court dismissed the bail in anticipation of arrest of two Government employees for commission of offences of forgery and criminal breach while taking advantage of their being public servants.
Justice Javed Iqbal Wani after considering the bail application and the objection filed therein by the prosecution said, the applicants prima facie seemingly are involved in the commission of serious offences.
Justice Wani while dismissing the bail application of both the accused recorded that both are appear to be involved in the commission of offences 486/409 (Forgery for purposes of cheating/Criminal breach of trust by public servant) in question while employing illegal means qua public money taking advantage of their being public servants.
Court said the contentions urged by the applicants that they never committed any offence much less the offences alleged and that they have been falsely implicated in the case can neither be looked into by this court at this stage unless the investigation of the case is completed by the investigating agency.
Court said, the investigating agency is yet to collect the documentary proof in the matter on account of closure the motor-able road connectivity in the area, therefore, grant of bail in anticipation of arrest at this stage of the investigation is likely to affect the investigation of the case while allowing the applicants a free hand to tamper with the evidence.
Court in view of the gravity and seriousness of the alleged offences committed by the applicants, said likelihood of their role of influencing the course of investigation inasmuch as, the infancy stage of investigation, the applicants are not held to grant of bail in anticipation of their arrest.
The applicants are stated to be working as contractual employees in National Youth Corps (NYC) and Gram Rozgar Sewak (GRS) in district youth services & sports department and Rural Development Department respectively and were on deputation to Rural Development Department and posted at Panchayat Nowpachi-A and Panchayat Nowpachi-B respectively.
