HC allows minor rape victim to terminate pregnancy

JAMMU, Feb 2: High Court has allowed a 15-year-old rape victim to terminate her pregnancy.
After hearing Advocate Narinder Atri for the petitioner whereas AAG Raman Sharma for the UT, Justice Ali Mohammad Magrey disposed of the petition with the direction that the respondents shall have the victim medically examined afresh by a Medical Board to be constituted by the Principal Government Medical College and Hospital (GMC&H) Jammu comprising of Subject Specialist including a Psychiatrist.
“The Board shall meet on February 5,2021 medially examine the victim and furnish the report to the Principal GMC&H Jammu”, High Court said, adding “the Board shall in the event, on examination of the victim, found her pregnant, recommend the termination of her pregnancy”.
“But necessary measures be also taken for preserving of DNA samples of the foetus and for the purpose, the official respondents shall also be associated in the process of completion of the directions”, High Court and directed Principal GMC to ensure providing of appropriate free medical facilities in the event termination of the pregnancy is undertaken.
High Court further directed Member Secretary  State   Legal   Services Authority to process the case of victim for payment of compensation.
