Srinagar, Feb 18: Inadequate and derisory report filed by Police in an extortion case has led to release of District Minerals Officer Kulgam, Dr Khursheed Ahmad, on interim bail.
A local court granted 4 days interim bail to District Minerals Officer (DMO) Kulgam with certain conditions as the police report about the commission of offence of the accused has not shown clear which has also been admitted by the prosecution during arguments before the court.
The accused DMO Dr Khurshid Ahmad Dar was arrested by police over the complaint against him on charges of extortion. The court of Additional Special Mobile Magistrate Awantipora presided by Raja Arshad Hamid after hearing the rival contentions and the Case Dairy said the IO while preparing his report has not been able to clear his stance on the fact that whether the accused was present at the place of occurrence or not.
Court further said the prosecution during hearing of the case has also admitted the doubtful existence and present of the accused at the scene of occurrence while going through the report submitted by the IO.
In view of the flaw and fault made by the investigation of the police in the case, the Court granted interim bail to accused upto February 20, 2021 with the condition of furnishing bail bonds of Rs 1 lakh. He has been directed to remain present before the IO from 12 noon to 4 pm daily till further orders and cooperate with the investigation agency in the case.
He has also been restrained from leaving the Valley without the prior permission of the court. Court has also made it clear that the bail order shall have no effect to the custody of the accused in case he is involved or required in some other case of FIR.
The FIR was registered against the DMO and others on the complaint alleging therein that the complainant was forced by DMO to deposit Rs 12000 in an account and moreover an amount of Rs 33000 was robbed by him from the driver of the complainant on February 12 when his driver Arif Bhat was stopped by a Scorpio vehicle at Letpora, Awantipora.
On receipt of complaint, an FIR was registered under section 341, 392 and 506 of IPC and after investigation and preparation of statements it was found that some persons including DMO were found to be connected with the occurrence which lead to his arrest on February 14 after preparing of arrest memo.
