JAMMU, May 8: City Judge Jammu Manjeet Rai today rejected the bail applications of Amandeep Singh, Rakesh Chowdhary, Surinder Singh, Vijay Kumar and Rishab Bhat allegedly involved in attack at Nagar Singh House.
According to the police case, on 03.04.2021 at about 22.00 hours an information was received through PCR in the Police Station Gandhi Nagar that some unidentified masked persons travelling in 2/3 vehicles numbers fired on residential premises of Nagar Singh with the intention to kill him.
On the receipt of such information, a case FIR No 91/2021 under Sections 307/120-B/149 IPC and 3/25 Arms Act was registered and investigation started. It has further been submitted in the report that Nagar Singh, Rakesh Singh, Jagar Singh and son of Nagar Singh and Royal Singh, son of Manjit Singh of Mohalla Dalpatian were tried in case FIR No. 247/2009.
The son of Nagar Singh died during trial and Nagar Singh, Rakesh Singh, Jagar Singh and others were acquitted in the case whereas Royal Singh was convicted and sentenced to life imprisonment. Royal Singh filed an application for grant of bail in High Court which was dismissed. Royal Singh feels that Nagar Singh wants him to remain behind bars as such he from Kot Bhalwal Central Jail in consultation and in conspiracy with his gang members namely Supreet Singh, son of Davinder Singh of Bhawani Nagar, Babar Khan, son of Ghulam Nabi of Bhawani Nagar, Pritam Singh, son of Mobin of Ramgarh, Yudhvir Singh, son of Aaya Singh of Chak Agra, Rakesh Kumar, son of Gegi Ram of Dayala Chak, Ajay Singh, son of Tirloki Nath of Anantnag, Prince Kapoor, son of Bharat Bhushan of Samba wanted that Nagar Singh and Rakesh Singh be got killed.
Kuldeep Kumar, who is posted as driver in jail facilitated through his mobile phone talks between Royal Singh and also arranged meetings between them. In pursuance to the conspiracy on 03-04-2021 seven accused persons came in cars bearing Registration No JK02U-6235 2, JK02AM-3033 and motorcycle bearing Registration No. JK02BH-3658 and started indiscriminate firing with the intention to kill Nagar Singh and his family members but no one was injured in the incident.
After hearing Additional Public Prosecutor Arvind Rathore for the UT, the court observed, “the accused are allegedly involved in the offences under Section 307/149 /212 /120-B IPC 3/25 Arms Act which are non-bailable and serious in nature, as such, they cannot claim bail as a matter of right”.
“No doubt, liberty of a citizen must be protected by a court. However, when a person is accused of offences of serious in nature, the court has to keep in mind the interest of the prosecution as well as the interest of the society but while granting bail in a non-bailable offence should take into account the various considerations, such as nature and seriousness of the evidence, the character of the evidence, circumstances which are peculiar to the accused”, the court said while rejecting the bail application.
