Accused booked under NDPSA acquitted after 13 yrs trial

JAMMU, June 12: 1st Additional Sessions Judge Jammu, Y P Bourney today acquitted one Sajjad Ahmed Wagey of Anantnag, who was facing trial under NDPSA.
According to the police case, on May 23, 1999 Incharge Police Post Sidhra along with others laid a naka at Circular Road near Sidhra ByePass Bridge and recovered 4 kilograms of charas from the possession of Sajjad Ahmed Wagey.
After hearing APP Harpal Singh for the State whereas Advocates KL Pandita and Sumir Pandita for the accused person, Ist Additional Sessions Judge observed, “there is a glaring contradiction in the statements of witnesses to the seizure and the report of weighing. The contradictions cast a serious doubt about the truthfulness of the testimonies of the prosecution witnesses”, adding “prosecution has failed to bring home guilt to the accused beyond shadow of reasonable doubt”.
Accordingly, the Court acquitted the accused of the charges leveled against him.
