Srinagar, Aug 2: High Court has upheld the quantum of sentence awarded by the trial court to accused persons for commission of offence of murder and refused to grant bail to them.
The division bench of Justice D S Thakur and Justice Puneet Gupta said that there is no case made out for the suspension of sentence and grant of bail to the appellants. “The bail applications are dismissed at this stage. It is made clear that any observation made in the order is confined only to the disposal of the present applications”, DB said.
Two Criminal Appeals were filed against the judgment of conviction and order of sentence passed by the trial court in December 2017 against Pankaj Sharma, Manpal Singh and another person seeking suspension of sentence and grant of bail in both the appeals.
The appellants have been convicted for commission of offence under Section 302 RPC and sentenced to undergo rigorous imprisonment for life and fine of Rs 50,000 each. In default of payment of fine they are to further undergo imprisonment of the like nature for a period of one year.
An FIR No. 160/2009 was registered with Police Station concerned u/s 302 RPC read with Section 3/25 Arms Act on the information received that one Harpreet Singh was shot dead on the intervening night of 26/27 November, 2009 by some person/persons.
