HC strictures against MD Handloom

Srinagar, Aug 5: The High Court today passed strictures against the Managing Director Handloom for not taking decision as per the judgment of the court.
Justice Javed Iqbal Wani while hearing contempt proceedings against the contemnor-Hashmat Ali Yatoo passed structures against the incumbent saying admittedly the official has not taken a decision regarding the benefits of pay accrued in favour of the petitioner-Qaiser Iqbal Yatoo as was provided in the judgment.
“Prima facie, there appears to be violation of the Court order/Judgment warranting initiation of appropriate proceedings against the respondent contemnor”, Justice Iqbal recorded.
Court granted last and final opportunity to him to comply with the order/Judgment by or before the next date with the condition that if he fails to comply with the orders of court then appropriate proceedings/orders shall be passed. Violation of order/Judgment passed by this Court dated 31-03-2021 is being alleged in the contempt petition.
According to the counsel for the petitioner, the authorities in terms of the Judgment were required to comply with the same within a period of eight weeks. The respondents are alleged to have not complied the same deliberately and intentionally.
According to Advocate appearing for the contemnor, the judgment has been passed and complied with, upon issuance of order dated 31st July, 2021, while revoking the suspension order of the petitioner. He sought some more time so that the respondent contemnor would comply with the judgment in its entirety.
Court after perusal of the order Judgment under contempt said, it reveals that eight weeks specific time from the date of passing of the judgment was granted to the respondents to not only reinstate the petition but also take a decision regarding the benefits of pay that had accrued to the petitioner through the period he remained under suspension but the same has not been done till date which prompted the court to record structures against the incumbent Director.
