Crime Branch books couple for fraud

JAMMU, Aug 18: Crime Branch Jammu has registered a criminal case against a couple – Bashir Ahmed and his wife Meena, residents of Narwal Pain Satwari for cheating / duping the complainant of Rs 8, 00,000 after offering sale of their house against a total monetary consideration of Rs 11.00 Lacs, despite knowing the fact that the land they were offering for sale, actually belonged to State/Defence Cantonment/Waterworks.
A written complaint was lodged by Sandeep Kumar Suri of Jawahar Nagar, Satwari Cantt, Jammu, alleging therein that the accused couple offered to sell their house for a total consideration amount of Rs 11, 00,000 and he paid an amount of Rs 8,00,000 as advance money with rest of the amount to be paid at the time of registration of sale deed /handing over the possession of said house. An agreement to sell was also executed between the two. The complainant requested the accused number of times to execute the sale deed and hand over the possession of house to him but accused delayed it on one or the other pretext. As the complainant got suspicious over behaviour of the accused, he enquired from the Revenue Department about the status of the land and house in question, where he came to know that the land over which the house exists does not belong to the accused and they are in illegal possession of the land. The complainant then insisted the accused person for refund of his advance amount. The accused assured the complainant that he would be proceeding on voluntarily retirement from service and would refund his money from the retirement benefits, whereas the accused had already taken retirement benefits way back, thus duping the complainant of Rs 8.00 Lacs with undue benefit to himself.
On receipt of this complaint, a preliminary verification was got conducted and the allegations were prima-facie substantiated. Thus, for the omissions and commissions on the part of the couple, a formal criminal case was registered U/S 420,120-B IPC for in-depth investigation.
