Excelsior Correspondent JAMMU, July 6: Principal Sessions Judge Kathua, M K Hanjura today rejected the bail application of Anil Kumar, son of Krishan Chand of Beli Charana and Talwinder Singh, son of Gurmeet Singh of Landra, who were involved in smuggling of capsules and other medical narco items. According to the police case, the narco smugglers were arrested along with large quantity of intoxicant syrup. Accordingly, a case for offences under Section 8/21/22 NDPS Act was registered against them. After hearing Advocate TN Gupta for the accused persons whereas Public Prosecutor Ravi Kumar Gupta for the State, Principal Sessions Judge observed, “the drugs recovered from the accused persons fall within the scales of the commercial quantity”, adding “this attracts the bar created by Section 37 of the NDPS Act. Therefore, the application of the petitioners does not deserve any consideration at this stage”. With these observations, court dismissed the bail applications.
