Bail denied in rape case

JAMMU, Sept 4: Presiding Officer Fast Track Court Jammu Khalil Choudhary has denied bail to one Gagan Angral, son of Prithvi Raj of Ashok Nagar Satwari, who has been booked under Section 376 IPC (rape offence).
The accused through the medium of instant application challenged the FIR No.23/2021 registered at Police Station Women Jammu under Section 376 IPC and sought the bail on different grounds.
However, the prosecution registered the application on the ground that accused under the promise of marriage with the complainant has raped and spoiled her life as such offences committed by the accused are non-bailable.
After hearing the counsel for the applicant, Additional Public Prosecutor for the UT and perusal of police report, the Presiding Officer Fast Track Court observed, “there are reasonable grounds to believe that the allegations/acquisitions leveled against the accused are prima-facie credible and plausible and that the investigating agency has completed the probe and charge-sheet is ready for presentation before the court”.
“On the overall analysis of the matter in its totality, I am of the considered opinion that at this tage there appear a reasonable ground for believing that accusation against the applicant/accused is prima-facie true as such there appears to be no merit and substance in the bail application of the petitioner”, the Court said.
