HC directs EO to hold elections to Coop Society

JAMMU, July 13: High Court has directed the Election Officer to proceed with the elections to the Cooperative Society but restrained him from declaring the results.
The direction was passed in a petition filed by Kirpal Singh and others.
After hearing Advocate SC Mansotra appearing for the petitioners whereas AAG HA Siddiqui for the State, Advocates Nirmal Kotwal and Vasu Dubey for the other respondents, Justice Ali Mohd Magrey observed, “AAG has submitted that the Rules/By-Laws stand amended and the District Election Officer, Jammu has notified the elections in terms of Supreme Court direction vide notification dated 27.05.2013”.
“The contents of the notification reveal that poll will take place on July 15, 2013 between 8 am to 4 pm at the Sainik Public School, Sainik Colony and the result will be announced after counting of votes on the same day”, the High Court said.
Justice AM Magrey further observed, “this Court in the pending litigation cannot stall the election that will amount to violation of the order of Supreme Court. However, in order to protect the interest of the parties it will be just and proper to direct the District Election Officer, Jammu to proceed and adhere to Election Schedule notified as per notification dated May 27, 2013 but he shall not declare the result unless further directions from this Court”.
