In the notice that has been sent through her counsel, Mehbooba has sought Rs 10 crore as compensation for the remarks that have defamed her and has lowered her reputation.
Malik, who is currently holding gubernatorial post in Meghalaya, had earlier made comments stating that Mehbooba Mufti was a beneficiary of the Roshi Scheme-which was later scrapped by the High Court. The Scheme also granted proprietary rights to occupants of State land.
The notice has come days after Malik made these remarks during a function.
“By conducting yourself as Ex-Governor of J&K State and making utterances about the benefit being taken by my client under Roshni Act, which are not only false and incorrect, you have defamed my client and have levelled scandalous and serious allegation against her with the sole objective of tarnishing her otherwise politically neat and clean image,” the notice read, adding, it is a fact that my client has never been beneficiary of State land under Roshni Act.
The notice asked Malik to pay Rs 10 crore within 30 days as compensation or face legal proceedings and treat the legal notice in terms of Section 80 CPC and “further consequences shall follow in case of non-compliance of the demand made herein.”
“Although no amount of money can compensate my client for the loss of reputation and good name which has been caused by your aforesaid conduct, yet my client has decided to sue you for compensation,” Mehbooba’s counsel wrote in the notice.
The notice underlined that the compensation money will not be used by Mehbooba Mufti for any personal gains, but the public good.
Pertinent to mention here, soon after Malik made these comments, Mehbooba took to Twitter and asked him to remove the comments immediately otherwise face legal action.
“False & unsavoury utterances of Satya Pal Malik about me being a beneficiary of Roshni Act is highly mischievous. My legal team is preparing to sue him. He has the option to withdraw his comments failing which I will pursue legal recourse,” Mehbooba wrote in a tweet.
Also, earlier, Malik had claimed that he was told that he would get Rs 300 crore bribe if he cleared two files belonging to Ambani and an RSS-affiliated man. He also praised Prime Minister Narendra Modi for supporting his decision saying there was no need to compromise on corruption.
Mehbooba also shared a video on her Twitter handle where the ex-J&K Governor is seen stating that Dr Farooq Abdullah, Omar Abdullah and the PDP chief Mehbooba Mufti got land plots under the Roshni scheme.
