HC directs action against DC ST

Srinagar, July 25: The State High Court today issued show cause notice to Deputy Commissioner Sales Tax and directed action be taken against him for allowing construction of two hotels illegally at Drang, Gulmarg in North Kashmir when he was Chief Executive Officer of Gulmarg Development Authority.
A Division Bench of High Court comprising Chief Justice M M Kumar and Justice DS Thakur issued show cause notice to DC Sales Tax, Mehboob Ahmad to explain his conduct as to how illegal constructions came up in Gulmarg during his tenure as the CEO. The court directed that suitable action shall be taken against Mehboob for his conduct.
The direction came after present CEO GDA, Tariq Ahmad Gania, in his compliance report stated that the two hotels have come up illegally in Drang during  the tenure of former CEO.
The present CEO was directed to explain as to how he is seeking control on the constructions and how many teams have been constituted in this regard. He was also asked to explain as to whether notice in acceptance with statutes has been issued to any illegal structure.
The Court further directed that no water supply and electricity supply be provided to these two hotels.
The court directed CEO to file the status of Master Plan as to whether it has been finalized or not.
The court in its observation told Advocate General: “you are holding such a highest post and not serious about the Court matters.”
