6 months imprisonment awarded in cheque bounce case

JAMMU, Nov 29: Special Municipal Mobile Magistrate Jammu Parveen Pandoh today awarded six months imprisonment and imposed fine of Rs 40 lakh on Ranjeet Kour in a cheque bounce case.
After hearing both the sides, the court observed that the accused has failed to raise probable defence which creates doubt about the existence of legal enforcable debt or liability. “The issuance of cheques, dishonour of the cheques and non-payment of money by the accused within 15 days from the receipt of demand notice has been proved but the accused could not raise a probable defence about the non-existence of legally enforable debt or that the liability stands discharged as alleged”, the court added.
Accordingly, court awarded imprisonment of six months and fine of Rs 40 lakh to Ranjeet Kour. The fine shall be paid to legal heirs of complainant as compensation. The court further directed that accused will undergo simple imprisonment of two months in default of payment of fine.
