Court rejects bail plea of 2 narco smugglers

JAMMU, July 26: Principal Sessions Judge Ramban, Md Akram Choudhary today rejected the bail application of Rakesh Kumar and Lakhbinder Singh, who were facing trail in NDPS case.
While rejecting the bail application, Principal Sessions Judge observed, “the prosecution has examined as many as 8 witnesses out of 15 listed in the column of witnesses in the charge-sheet. On perusal of the prosecution evidence, it appears that all the witnesses have supported the prosecution case as eye witnesses have deposed that recovery and seizure were made in their presence”.
“The forensic expert had also deposed that the samples contained morphine and that the same were identified as poppy straw. Therefore, there is no material/evidence on record to suggest that the accused/applicants had not committed the offence, which is required for recording of satisfaction by the Court while granting of bail in NDPS Act case of commercial nature”, the court further observed.
