DB’s directive on land grabbing PIL

JAMMU, July 29: In the much publicized PIL against alleged land grabbing by the politicians, police officers and bureaucrats in connivance with land mafia, Division Bench of State High Court comprising Justice Virender Singh and Justice Ali Mohd Magrey today granted last opportunity to the State for filing compliance report.
When the PIL came up for hearing, Senior Additional Advocate General, Gagan Basotra, who was appearing on behalf of AAG HA Siddiqui, sought more time to comply with the order dated July 3, 2013.
After hearing Advocates S S Ahmed, A M Malik, S K Shukla appearing for the petitioners whereas Senior AAG Gagan Basotra, Deputy AG Z S Wattali for the State, Senior Advocate Sunil Sethi with Advocate Ravi Abrol for the RB Educational Trust, the DB granted three weeks time to the State for filing compliance report.
“It shall, however, be the last opportunity otherwise it shall be presumed that the State has no stance to put forth at least on facts”, the DB said.
The Division Bench in the earlier orders had directed Commissioner Secretaries of the General Administration and Revenue Departments to file their affidavits indicating as to
how many cases under the Jammu & Kashmir State Lands (Vesting of Ownership to the Occupants) Act, 2001 are under process along with the names, persons and quantity of land on which ownership rights are sought. The DB had also directed the State to furnish details about the number of persons on whom ownership rights have been conferred.
