DB disposes of PIL challenging constitution of Recipe Committee

JAMMU, Dec 20: Division Bench of the High Court comprising Chief Justice Pankaj Mithal and Justice Javed Iqbal Wani have disposed of the Public Interest Litigation (PIL) regarding the constitution of various committees for the Anganwadi Centers and for laying down recipes for the mid-day meals to be provided therein with the direction to the petitioners to make a comprehensive representation to the Secretary, Social Welfare Department.
It was submitted before the DB that the impugned order dated 24.10.2019 issued by State Mission Director, Integrated Child Development Services (ICDS) constituting the Recipe Committee and prescribing the recipe where under in age group six months to 3 years, the quantity and quality of oil and salt have been prescribed is in violation of the Decentralized Policy for Procurement of Supplementary Nutrition under ICDS scheme for Rural/Urban Areas.
“Since the policy has been issued by the Secretary, Social Welfare Department, if anything contrary to it is being done, it is for him to verify and to check the same”, the DB said and disposed of the writ petition with the direction to the petitioners to make a comprehensive representation to the Secretary, Social Welfare Department regarding the violation of the policy especially with regard to constitution of the Recipe Committee and the ingredients of the recipe provided therein.
DB further ordered that in the event, any such representation is made, the Secretary would consider it in the light of the policy in vogue and take appropriate action as may be necessary in the facts and circumstances of the case.
