HC directs authorities against withdrawal of security to former AAG

Srinagar, Jan 5: High Court has directed the Home Department not to withdraw the security cover and accommodation allotted to the former Additional Advocate General, Bashir Ahmad Dar, till they review his threat perception.
Dar, submitted before the court that after his resignation from the post of senior Additional Advocate General in the Srinagar wing of High Court authorities are contemplating to withdraw his secured accommodation as well as security vehicle. He told the court that he was assessed as a protected person by the State Level Review Committee in 2017.
It is further added that since he relinquished his office, authorities without even reviewing his threat perception through a Designated Committee are contemplating such a process and if they are permitted to do so, the petitioner would be exposed to serious security threat and his life as well as life of his family members would be at serious risk.
Court after hearing the counsel for the petitioner opined that unless review of threat perception to the petitioner is conducted through a Designated Committee and the respondents come to a definite conclusion that he does not require any security, it would be totally unjust and arbitrary to withdraw the security cover which was extended to the petitioner while he was working for the UT of Jammu and Kashmir as senior AAG.
Justice Sanjeev Kumar while issuing notice to the authorities for filing of response indication there in the finding of review committee with regard to withdrawal of secured accommodation to the petitioner, directed the authorities not to withdraw the security cover extended to the petitioner which include secured accommodation allotted to him and a vehicle provided to him.
“The respondents are, however, free to conduct the review of threat perception to the petitioner and come up with their findings along with the reply which they file in this petition”, Court said.
