HC stays SRO removing Special Public Prosecutor in Chopras murder case

JAMMU, Aug 8: High Court today stayed the SRO 324 dated July 10, 2013 whereby Secretary Law Department has cancelled the appointment of Advocate L K Sharma as Special Public Prosecutor in the much publicized Chopras murder case and appointed Public Prosecutor Shabir Ahmed Choudhary for trial of the case.
After hearing battery of lawyers for the both the sides, Justice Janak Raj Kotwal observed, “several questions vis-à-vis appointment of a Special Public Prosecutor for a case and termination of SPP without hearing the person on whose request or behest he was appointed, arises for consideration when the petition is taken for consideration”.
Stating that no urgency was found in the removal of Special PP, Justice Kotwal said, “the court feels it expedient in the fitness of things that service of LK Sharma as Special Public Prosecutor can be continued”.
With these observations, Justice Janak Raj Kotwal stayed the impugned SRO No 324 dated July 10, 2013 till next date of hearing and allowed Advocate LK Sharma to conduct trial of the case as a Special Public Prosecutor.
