HC asks CAT to reconsider plea of JEs seeking promotions

SRINAGAR, Jan 31: High Court while setting aside the order of Central Administrative Tribunal (CAT) Srinagar denying interim relief to the aggrieved Junior Engineers asked the CAT to consider the matter a fresh and pass order on merits of the case.
The Junior Engineers of PW(R&B) had approached the court against the promotions made by the department from JEs to AEs in Mechanical and the aggrieved JEs were left out from such promotion constraining them to approach the CAT. The CAT while considering the matter, refused to grant any interim relief to the aggrieved JEs.
The aggrieved JEs approached the Division Bench of High Court comprising Justice Ali Mohammad Magrey and Justice Vinod Chatterji Koul against the CAT order and the DB allowed their plea and set aside the order of CAT and asked it for considering the matter a fresh and passing of orders on merits.
The DB said the matter wherein the impugned promotion order of AEs has been challenged by the aggrieved JEs, cannot be kept pending awaiting decision pending before this Court, therefore, OA needs to be considered for grant of relief in accordance with law by not keeping the same pending merely because two writ petitions are pending before this Court.
