JAMMU, Feb 3: A Bench of the Central Administrative Tribunal (CAT) at Jammu comprising Dr Bhagwan Sahai and Rakesh Sagar Jain has quashed the selection of Mohd Hussain Mir as Lecturer in Super Speciality (Medical Oncology) GMC Jammu and directed to consider the candidature of applicant for the post.
The case of the applicant was that he having qualification of MBBS, MD (Medicine) and DNB (Medical Oncology) had applied for the post of Lecturer in Medical Oncology in Super Speciality Hospital, Government Medical College Jammu in pursuance to Notification No.:03-PSC (DR-P) of 2016 dated 19-02-2016 issued by Public Service Commission.
The PSC thereafter issued the impugned final select list vide Notification No. 01-PSC (DR-S) of 2018 dated 09-02-2018 selecting Mohd Hussain Mir instead of the applicant (Dr Rajeev Gupta) despite the fact that the applicant is more meritorious. Besides this, the certificate presented by the applicant regarding his participation as a speaker in the national and international seminars was not considered by the experts, and no marks were given for it despite the fact that the applicant is entitled to marks for the certificate in terms of sub-clause III of clause 4 of Notification No. 06-PSC (DR) of 2017 dated 07-062017.
After hearing Advocate Rohit Kohli for the petitioner whereas Deputy AG Rajesh Thappa for the UT Govt and Advocate FA Natnoo for the PSC, the CAT ordered that impugned select list issued vide Notification No. 01-PSC (DR-S) of 2018 dated 09.02.2018 whereby respondent was selected as Lecturer Super Speciality (Medical Oncology) (GMC, Jammu) is set aside and respondents are directed to consider the candidature of the applicant for the post of Lecturer Super Speciality (Medical Oncology) (GMC, Jammu).
