HC admits Geelani’s grandson plea against his dismissal from service

Srinagar, Feb 3: High Court today admitted Syed Ali Shah Geelani’s grandson’s plea challenging his dismissal from Government Services and issued the notice to the authorities for filing of counter affidavit into the plea by next date of hearing.
Geelani’s grandson, Anees ul Islam has approached the High Court through the medium of the writ petition challenging the Government order dated 16. 10.2021 whereby his services from the post of Research Officer in Sher-e-Kashmir International Convention Centre (SKICC) were dismissed.
Justice D S Thakur after hearing the counsel appearing for Anees admitted the petition at its threshold and issued post admission notice to the authorities including Secretary GAD, Director SKICC and others for filing of counter in opposition to the plea of the petitioner.
The petitioner challenges the impugned dismissal order on the ground that the same has been purportedly issued in exercise of powers claimed to be vested in Lieutenant governor in terms of sub-clause (c) of the proviso to clause(2) of Article 311 of the Constitution of India on the mistaken assumption that he is an employee of government of J&K and holds a civil post under the government of J&K while he was appointed and working on a post available on the establishment of Director Centaur Lake View Hotel, Srinagar which is an autonomous body and a separate legal entity quite distinct from the government of J&K.
His counsel informed the court that petitioner-Islam was neither an employee of the government nor holding any civil post as understood in Article 311 of the Constitution of India. There was no relationship of employer and employee between petitioner-Anees and Government.
