Army man accused of killing wife acquitted

JAMMU, Aug 16: Principal Sessions Judge Jammu, Kartar Singh today acquitted Jasbir Singh, an Army jawan who was allegedly involved in the murder of his wife as prosecution miserably failed to prove the case.
According to the police case, on April 7, 2008 an information was received that the accused Jasbir Singh, who was serving in the Army, inflicted injuries on the face, neck and head of his wife Chinta Devi with the Khokhri with the intention to commit her murder.
On this information, FIR for the commission of offence falling under Section 307 RPC read with Section 4/25 Arms Act was registered. Later, Chinta Devi succumbed to the injuries. After completion of investigation, police presented challan in the court.
After hearing Advocate O P Sharma appearing for the accused person whereas PP Shabir Choudhary for the State, Principal Sessions Judge observed, “the statement of the accused was recorded under the provisions of Section 342 CrPC in which he has taken a defence that on the day of the occurrence he was not at home and had gone to Pathankot in connection with his temporary duty”.
“Prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt. The circumstances relied upon by the prosecution connecting the accused with the commission of the alleged offence have not completed the chain so as to exclude the innocence of the accused”, the Court said.
“The court is left with no other alternative except to acquit the accused”, Principal Sessions Judge said while acquitting the accused of the charges framed against him.
