Interim bail granted to JE MES

JAMMU, Mar 8: Special Judge Anti-Corruption (CBI Cases) Jammu R K Wattal has granted interim bail to Mahesh Chandra Gangwar, JE MES Satwari, who was arrested under Prevention of Corruption Act.
Advocates S K Bhat and Surekha Bhat appearing for the applicant submitted before the court that the accused is having one child who is two years old and his wife is also unemployed therefore he is the only person to look after his family which is deprived of the legitimate rights.
“There is also apprehension that he may commit suicide under the pressing circumstances as he is under depression due to the death of his colleague”, the counsels for the accused further submitted.
However, prosecution submitted that applicant being a public servant has committed heinous offence under Prevention of Corruption Act and there is every likelihood that if granted bail he may tamper with evidence and influence the witnesses.
After hearing both the sides, the court observed, “so far as the nature and seriousness of the crime under Prevention of Corruption Act is concerned ordinarily bail doesn’t deserve to be granted in routine manner to the accused who are prima facie involved in the offence unless the investigation is complete and there is no likelihood of the witnesses being influenced by the accused but now the charge-sheet stands filed against the accused and no investigation part is left”.
“The prosecution, however, has not produced sanction as yet for which Public Prosecutor has sought the opportunity to obtain the same and place it on file”, the court said, adding “at this tage the apprehension of hampering of investigation or tampering of evidence is not substantiated”.
With these observations, the court ordered that accused be released on interim bail for two months on furnishing bail bonds of two sureties of Rs one lakh each and person bond of like amount on the condition that he shall cooperate with the investigating agency.
