2 narco smugglers acquitted

JAMMU, Aug 22: Principal Sessions Judge Jammu, Kartar Singh has acquitted Arjun Singh and Sham Lal of the charges of smuggling poppy straw as prosecution failed to connect them with the commission of alleged offence.
According to the police case, in the month of June 2007 R S Pura Police arrested the accused persons along with poppy straw. Accordingly, a case under Section 8/15 NDPS Act was registered against the accused and after investigation final report was submitted in the court.
After hearing both the sides, Principal Sessions Judge observed, “according to prosecution story sample sealed on spot was sent to FSL but there is nothing on the file as to state when sample was sent to FSL and whether it was got re-sealed by the Executive Magistrate or not as required under the provisions of NDPS Act. The report of FSL is on the file but it has not been proved by the prosecution”.
“Not even a single material document has been proved against the accused in order to connect them with the commission of alleged offence. In other words there is not even an iota of incriminating evidence against the accused”, the court observed and acquitted the accused of the charge framed against them.
