SRINAGAR, Apr 8: High Court has sought a compliance report from the Deputy Commissioner, Baramulla after the district administration failed in issuing an RBA certificate to an individual, prompting him to move the court for relief.
Petitioner Mukhtar Ahmad, a resident of Garkote village of Uri filed a petition in this regard, through advocate Naveed Bukhtiyar and Asif Wani in the High Court, claiming that he had approached the Tehsildar, Uri, under the Jammu and Kashmir Public Service Guarantee Act, 2011 for issuance of a certificate, which has not been issued in his favour.
The failure on the part of Tehsildar to issue the certificate forced the petitioner to approach the Deputy Commissioner, Baramulla, in an appeal which is pending for the last three months without any decision whatsoever on the said appeal.
It is further stated, the order said, that the entire purpose and scope of the Act of 2011 is defeated in case the said Authorities including the Appellate Authority prescribed in the said scheme fail to discharge their respective duties.
“The issue raised in the present petition is indeed of an important nature where a helpless citizen has been forced to approach the High Court on account of the failure of statutory bodies to perform their statutory duties as envisaged in the Act of 2011.”
The Court said that it would be apt for the Appellate Authority/Deputy Commissioner, Baramulla, to decide the appeal within one week from the date a copy of this Order is served upon the said officer.
“A compliance report be also filed in the High Court with regard to compliance of this Order. A copy of this Order be served on the Deputy Commissioner, Baramulla through the Registrar Judicial of this Court,” the order stated.
