Judge stays lower court’s order of lodging FIR against cops

REASI, May 7: Principal Session Judge, Reasi, R N Watal today stayed the lower court’s order on lodging of FIR against seven cops of Police Station Chassana for allegedly putting a local’s life at risk.
While hearing a revision petition against the order dated 05-05-2022, passed by the Additional Special Mobile Magistrate Reasi in complaint titled Prem Singh versus Rohit Sharma and others, Judge Watal observed that the grounds projected in the revision petition require re-look of the impugned order in terms of section 397 of CrPC.
“Call for the record of the court below, issue notice to the respondent, in the meantime the impugned order is kept in abeyance till next date of hearing on May 21, 2022,” ordered the Judge.
Earlier on May 5, Court of Additional Special Mobile Magistrate, Reasi, Priyanka Mahajan, while disposing of the application by one Prem Singh, son of Chatter Singh of Thakrakote in Tehsil Chassana, had ordered lodging of FIR against seven cops of Police Station Chassana who had allegedly put house of the complainant on fire on September 19, 2021.
The accused Policemen include two Sub-Inspectors, two Havaldars, two SPOs and one Head Constable; all posted in Police Station Chassana.
As per the complainant, the accused surrounded his Kacha house from all the corners and put fire to a pile of wood on the roof of the house as well as door. To save his life, Prem Singh moved with his family to tin shed and closed the iron door. The accused allegedly asked him and his family to come out from house and threatened them of serious consequences in case they fail to do so. On hearing noise and seeing smoke, Singh said people of the locality came there and subsequently the accused fled away from the spot.
The complainant said that he approached the SHO concerned and other police officers to register the FIR against the accused persons but to no avail. Consequently, he filed complaint with the court under Section 156(3) CrPC for seeking direction to the SHO concerned for registering of FIR against the accused persons.
“Applying my mind in the facts of the instant application, it is clear that applicant has come to the court after exhausting the remedies of approaching concerned police station and SSP for the lodging of FIR but without any reason same was not done. “As such the SHO Chassana is hereby directed to register an FIR against the accused persons and investigate into the matter,” reads the order, passed by ASMM Reasi, which was stayed today by Principal Session Judge, Reasi.
