Govt discharges doctor from service

JAMMU, Sept 4: Government has terminated the probation of Consultant Surgeon Dr Javid Iqbal and discharged him from the services.
An order to this effect, was issued by Commissioner /Secretary to Government, Health & Medical Education Department here, today.
The services of the Dr Javed Iqbal, son of Mohammed Abdullah of Nadian, Rajouri working as B Grade Surgeon with Department of Health Services Jammu were terminated under rule 21 (1) b of J&K Civil Services (Classification, Control & Appeal) Rules, 1956 as the official was involved in case of criminal nature and has remained absent from duty for a long duration, apart from being in police/judicial custody.
The Government, while terminating the probation of the doctor has made it clear in its order that the doctor is not suitable to be retained in the Government service and his continuance in Government job was also not in the interest of the department in view of his past track record. The official has remained under suspension from August 24, 2011 to February 2, 2012 and from May 16, 2012 to September 29, 2012 totaling a period of 9 months and 23 days. Besides, he has also remained in police custody for 42 days.
The doctor was earlier reinstated by the department, despite an FIR was lodged against him in Police Station Rajouri.   But later when his case was referred to the Law, Justice & Parliamentary Affairs Department for its opinion, it recommended that the probation period of the doctor be suspended and department was within its rights to do so. It further recommended that the department can discharge him from the service if it is satisfied that the continuance of the doctor in the service is not in the interest of the department. The Law Department in its opinion has also made it clear that the official has remained absent from duty and it is essential ground for taking action against him.
It may be recalled that earlier following the directions of Chief Judicial Magistrate (CJM), Janipur police had registered a case against the doctor and his family members for allegedly keeping his wife in captivity and assaulting her.
The victim after escape from the house lodged a complaint with Janipur police and after the inaction of police the victim approached the court which directed Janipur police to lodge a case in this regard.
Police have registered a case FIR 114/12 under Sections 420, 465, 468, 471 and 120-B against Dr Javed Iqbal, a Rajouri based medico and his family members.
Police said that Dr Javed Iqbal a B-Grade Surgeon of Medical Department and husband of Smaira Choudhary alias Gurpreet Kour, who fell in love during their study stint at PGI Chandigarh. During that period the accused Dr. Javed Iqbal promised to get married. On completion of his course he left Chandigarh and remained elusive. The complainant got the telephone number of Dr. Javed Iqbal and came to Jammu, from where she went to Rajouri and met relatives and family members of the accused where they decided to conduct the marriage, but it did not happen as per the statement of complainant. A complaint was filed by Smaira Choudhary alias Gurpreet Kour before the SSP Rajouri and a case under Section 376 was registered against the accused Dr. Javed Iqbal.
Upon this family members of Javed Iqbal asked the complainant to convert into Islam, she agreed and thereafter she married Dr. Javed Iqbal but after marriage he and other relatives started demanding dowry. As part of the dowry she arranged more than Rs 50 lakhs but even after that her husband and relatives taunted her and beat her. Upon this, she filed a complaint in the Court of CJM Jammu under Section 498-A RPC. CJM sent this complaint to Women Cell. In her complaint she stated that besides committing physical torture, mental & sexual tortures, the accused has misappropriate property of Rs 50 lakh for which she has filed a separate complaint before the Court. Police registered a case under Sections 498-A/420/409/406/120-B RPC.
