Court directs police to register FIR against Al-Aziz Nursing Home

SRINAGAR, June 9: In an unprecedented move, the Chief Judicial Magistrate, Srinagar has directed the SHO, Khanyar to register an FIR against the proprietors of Al-Aziz Nursing Home/Hospital situated at Khayyam for breaking the seal affixed by the concerned authorities on the Ultrasound Unit situated in the Nursing Home and for its illegal operations.
This has been done on the written complaint filed by the Chief Medical Officer, Srinagar (competent authority for regulating the PNDT Act in the State) before the Court.
The Chief Medical Officer, Srinagar along with a team of doctors during a surprise visit to the hospital on January 17, 2012 found that the proprietors were running the Nursing Home illegally in contravention to the norms as laid down under J&K Nursing Homes and Clinical Establishments (Registration & Licensing) Act as well as J&K PC & PNDT Act, 2002, without any permission from the competent authority. The proprietor was also running the USG unit in the Nursing Home without the permission of the authorities under J&K PC & PNDT Act 2002.
In view of these violation, the CMO, Srinagar sealed the USG unit on April 28, 2011, but during the routine inspection on January 17, 2012, the team found that the management of the Al-Aziz Nursing Home had broken the seal and running the unit illegally which prompted the authorities to lodge a written complaint with the police as well as in the competent Court for appropriate action against the concerned.
