2 brothers acquitted of murder charges

JAMMU, Sept 18: Principal Sessions Judge Poonch, Jaffer Hussain Beigh has acquitted two real brothers namely Bhag Hussain and Nazir Hussain of the murder charges as prosecution failed to prove the case.
According to the police case, on April 21, 2010 both the brothers brutally assaulted the father of complainant Ishtiaq Ahmed over a trifle issue and later the victim died. Accordingly, a case was registered at Surankote Police Station and after completion of investigation presented challan in the court of law.
After hearing Choudhary Nazir Hussain, Public Prosecutor for the State whereas Advocate Mohammad Aslam for the accused, Principal Sessions Judge Poonch observed, “the prosecution witnesses have not supported the prosecution at all but have denied the occurrence. All these prosecution witnesses were declared hostile by the court at the request of the prosecution and the prosecution was allowed to cross-examine them but nothing incriminating has been elicited  from their statements on cross-examination”.
“As they have denied the occurrence, there is no evidence in order to connect the accused with the commission of the crime.  Not only this, there is absolutely no evidence on the file so that the accused can be asked to enter upon defence”, the court said while acquitting the accused of the charges framed against them.
