FC Revenue orders transfer of cases from ADC/ ACR’s courts

JAMMU, July 22: Taking serious view of the long pendency in the disposal of Revenue Court cases in the courts of ADC and ACRs at district headquarters, the Financial Commissioner Revenue, J&K UT has ordered the transfer of cases pending with Additional Deputy Commissioners (Hqrs), pertaining to the Tehsils outside their territorial jurisdiction to the ADCs, within whose territorial jurisdiction the Tehsil falls.
The FC Revenue after monitoring cases on RCCMS, observed that a large number of cases are pending disposal in these courts and this has led to inordinate delays, causing inconvenience to the litigants and dissatisfaction with the official machinery. Therefore, it was felt necessary to rationalize the functioning of the Revenue courts.
The order, however, said that the cases shall be transferred at the time of hearing, already notified and the parties shall be directed to cause their appearance before the court to which the case has been transferred. Parties are not required to be issues afresh date. It further directed that the date to be indicated shall not be later than two weeks, within which time the court file shall be transferred to the new court. On the date of transfer, the transfer shall also be effected on the Revenue Court Cases Monitoring System (RCCMS), the order said.
It was, further ordered that the cases which stand argued and reserved for orders shall, however, not be transferred but continue in the court of ADC (Hq), who shall pronounce the order on the date notified to the parties, without fail and no adjournments shall be given.
Similarly, the court cases pertaining to Agrarian Reform matters, pending with the Assistant Commissioner ( Revenue), in the capacity of Collector Agrarian Reforms , are hereby transferred to respective SDMs in whose Territorial jurisdiction the cases fall, for due disposal under law. The courts (ADC/ACR) located at the headquarters shall submit case wise list of cases transferred and retained in a week’s time from the issuance of this order.
