SC upholds quashing of SBI employee’s termination

JAMMU, Oct 3: Supreme Court Bench comprising Justice Surinder Singh Nijjar and Justice F M Ibrahim Kalifulla has dismissed the Special Leave Petition (SLP) filed by the State Bank of India against the judgement of Division Bench of State High Court and upheld the order quashing termination of bank’s employee, who was provided justice after 26 years long legal battle.
According to the facts of the case, Chanchal Singh, son of Janak Singh of Channi Rama was working as peon in the State Bank of India. He was convicted under Section 380 RPC and ordered to pay a fine of Rs 200 by the Chief Judicial Magistrate, Kargil on November 11, 1987. However, sentence of four years awarded by the CJM was suspended releasing him on probation on the ground that the Chanchal Singh was first offender, 21 years old and large family of minor children to support.
However, on August 9, 1988 bank passed order terminating the services of Chanchal Singh on the basis of conviction dated November 11, 1987. After 26 years long legal battle, Chanchal Singh received justice from the High Court, which set aside the termination order and held Chanchal Singh entitled for all service benefits.
The order of the Single Judge was challenged by the State Bank of India in the Division Bench, which in the month of May this year upheld the Single Judge order. However, the DB’s decision was challenged by the bank in the Supreme Court but again verdict came in the favour of Chanchal Singh.
