JAMMU, Oct 11: Principal Sessions Judge Jammu, Kartar Singh today dismissed the revision petition filed by Choudhary Nagar Singh against the order of Chief Judicial Magistrate Jammu dated February 19, 2013 whereby proceedings against Basant Rath, the then SSP Jammu, Mubassir Latifi, the then SP, Abdul Rouf Lone, Kamaljeet Singh and Hardeep Singh Gill were dropped.
After hearing Advocate R K Kotwal for the petitioner whereas Senior Advocate K S Johal and Advocate Sheikh Shakeel Ahmed for the police officers and going through the revision petition, Principal Sessions Judge observed, “it appears that the act complained by the petitioner and the official duty performed by the respondents are so inter-related that one can postulate reasonably that it was done by them in the performance of the official duty while investigating a serious case though possibly in excess of the needs and the requirement of the situation or even it may be a case of pure dereliction of duty”.
“The order passed by the trial court does not suffer from any illegality or impropriety so as to warrant interference by this court”, Principal Sessions Judge said while dismissing the revision petition.
