5 militants charge sheeted

SRINAGAR, Nov 7: Police today produced charge sheet against five persons including three dead Lashkar-e-Toiba (LeT) militants for abduction and murder of an Army soldier in Budgam district of Kashmir.
A police spokesman said that police in Budgam produced a charge sheet against five accused persons for abduction and murder of an army personnel at Lokipora Khag Budgam.
He said that they include Athar Illahi Sheikh son of Ghulam Mohammad Sheikh of Lokipora Khag, an OGW of LeT who is lodged in Kot Bhalwal Jail; Mohammad Yousuf Dar alias Kantroo son of Abdul Ghani Dar of Cheki Kawoosa Narbal, LeT commander who was killed; Faisal Hafeez Dar son of Hafizullah Dar of Aripanthan Magam, the LeT militant who was killed; Hilal Ahmad Sheikh alias Hanzullah son of Abdul Hameed Sheikh of Shrakwaari Wagoora Baramulla who was killed and active foreign militant Ghazi Bhai alias Pathan Bhai alias Usman Bhai of LeT.
The spokesman said that on 7th March this year at around 21:30 hours, Police Station Khag received a complaint about missing of one in-service Army soldier on leave of 05 JAKLI Mohammad Sameer Malla son of Mohammad Yaqoob Malla of Lokipora Khag and accordingly search of the missing person was started.
After 3 days on 10th March 2022, upon specific information, dead body of the missing Army personnel was recovered who was found buried in a ditch in fields of village Labran Khag.
“Accordingly, a formal case (FIR number 09/2022 U/S 364, 302 IPC) was registered in Police Station Khag and investigation taken up,” he said.
“During the course of investigation one OGW Ather Illahi Sheikh was apprehended who upon questioning admitted that he along with other four accused militants of LeT abducted Mohammad Sameer Malla on 7th March and they tortured him which resulted in death of Mohammad Sameer Malla in an orchard of Labran village and buried the dead body of the victim in a ditch in nearby field,” they said.
He said that accordingly Ather Illahi Sheikh was arrested.
“During investigation and search, three militants involved in the crime were killed in anti-militant operation in Village Malwa Kunzar on 21/22 April 2022 while 5th accused Ghazi Bhai alias Pathan of Pakistan origin militant is still at large,” he said.
“During further investigation and collection of evidences in the case, offences under section 364, 302,392, 201, 149IPC, 16, 18, 19, 20, 38, 39 ULA(P) Act were established against the 5 accused and the charge sheet to this effect was produced before court after obtaining the sanction from the competent authority,” he said.
“Pertinent to mention that expert opinions were to be obtained from CFSL Chandigarh due to which producing charge sheet got little bit delay,” read the statement.
