HC disposes of petition for being rendered infrutcuous

JAMMU, June 14: The petition filed by Ravinder Gupta, then Managing Director (now attached with Divisional Commissioner Jammu) seeking quashment of his attachment was disposed of by the High Court for having been rendered infructuous.
Senior Advocate Sunil Sethi with Advocate Veenu Gupta appearing for the petitioners submitted that in view of order No 639-GAD of 2012 dated June 8, 2012 the respondents have realized that order dated May 30, 2012 was not in consonance with law, therefore, he may have to work out the remedy against such order.
In opposition, it was the submission of counsel for the respondents that earlier order which has been modified was also passed by the competent authority.
During the course of arguments, AAG Gagan Basotra produced a copy of Government Order No 639-GAD of 2012 dated June 8, 2012 whereby earlier order dated May 30, 2012 has been modified and where under Divisional Commissioner Jammu has been asked to enquire into the complaints received by the Government pertaining to functionaries and functioning of JAKFED and the petitioner Ravinder Gupta as well as Girdhari Lal Abrol, General Manager JAKFED have been directed to report to the office of Divisional Commissioner Jammu.
After considering the submissions of both the sides, Justice Mohammad Yaqoob Mir observed, “it is open for the petitioner to work out the remedy as shall be available to him against such order. In view of Government order No 639-GAD of 2012 dated June 8, 2012, this petition is rendered infructuous, as such dismissed, leaving it open to the petitioner to work out the remedy as shall be available to him”.
