JAMMU, Oct 17: Principal Sessions Judge Jammu Kartar Singh has acquitted a woman and her paramour of the charges of committing the murder of a man as prosecution failed to prove case.
According to the police case, Sunil Kumar, son of Karan Singh of Rangpur Mulliana was having illicit relations with Sita Devi, wife of Rattan Lal and they killed Rattan Lal after the latter came to know about their relations.
After hearing both the sides, Principal Sessions Judge observed, “no prosecution witness has stated that the accused were having illicit relations with each other. In other words, there is not even an iota of incriminating evidence to connect the accused with the commission of alleged offence”.
“With these words of pain and sorrow for the deceased, the court is left with no option except to acquit the accused”, Principal Sessions Judge said”. Passing structures against the Public Prosecutor, the Court said, “when the judgment was being dictated in the office chamber, the Public Prosecutor barged into the room and uttered derogatory remarks by saying that this case has been disposed off as if it is an application under Section 107 CrPC”.
“Though the words uttered by the Public Prosecutor were derogatory and contemptuous but even then the court exhibited patience. It is pointed out that either the PP does not know alphabets of law or he was taken by surprise while disposing of the case in which he might have some interest and what that interest can be, needs no elaboration”, Principal Sessions Judge said.
