Court acquits accused facing rape charges

JAMMU, Dec 2: Presiding Officer Fast Track Court Jammu Khalil Choudhary has acquitted one Raman Kumar, son of Vijay Kumar of Domana of the rape charges leveled against him as prosecution failed to establish its case against him beyond any reasonable doubt.
The FIR against Raman Kumar was registered on the basis of complaint received from a girl that she was repeatedly raped by alleged accused on the pretext of entering into wed-lock with her.
After hearing both the sides, the court observed, “in the present case, the accused and the prosecutrix fell in love and their relationship turned into physical relationship and when the accused refused to marry with the prosecutrix she lodged FIR against the accused”.
“The accused has also admitted in his statement that she had solemnized marriage with the prosecutrix and they are living happily and due to some misunderstanding she lodged a false case against him”, the court observed, adding “the accused promised to the prosecutrix that he will marry with her at the later stage and she gave consent for sexual intercourse”.
“The marriage was solemnized and the accused fulfilled his words and not breached the promise. So the allegations in the complaint don’t on their face indicate that the promise by the accused was false”, the court said, adding “over all analysis of the evidence of prosecutrix and other witnesses there is nothing on record that accused committed the rape with the prosecutrix on the false promise of the marriage”.
“Therefore on cumulative consideration of the matter in its totality, I am unhesitant to record that prosecution evidence cannot be said to be definite, positive consistent and coherent so far as the cause against the accused is concerned”, Presiding Officer said and accordingly accused Raman Kumar of the charges leveled against him.
