HC for personal appearance of DHSK

SRINAGAR, Dec 26: The Division Bench of High Court has directed Director Health Services Kashmir (DHSK) to appear in person for not complying with the orders with regard to providing job to the petitioner in lieu of taking his land for construction of Primary Health Centre (PHC).
The Division Bench of Justice Sanjeev Kumar and Justice Moksha Kazmi directed the DHSK to appear in person before the court on the next date of hearing in case he fails to complete the compliance of court judgment passed on May 11 this year.
Petitioner-Ghulam Nabi Dar has moved three Writ Petitions, involve common question of facts and the law and the court while deciding the same took up all the three cases jointly and disposed of the same in a common judgment with the liberty to the Petitioner-Dar to approach the authorities with a representation for seeking redressal of his grievance, as projected in these Petitions.
Court upon receipt of any such representation on part of the Petitioner had directed the authorities to consider the same and pass appropriate orders thereon in accordance with law and communicate the decision so taken to the Petitioner most expeditiously.
Failing to redress the grievance of the petitioner, he filed the contempt petition for flouting the court judgment and the court while hearing the contempt petition said the status report filed by the authorities indicate that the matter has been referred to the DHSK, for consideration in terms of communication dated 30.05.2022, issued by the Under Secretary to the Government Health and Medical Education Department and the same is under consideration.
The respondents submitted before the bench that as and when a decision in this regard is taken, the same shall be placed on record. “Irfan Andleeb, Dy AG, prays for and is granted last and final opportunity of four weeks to file complete compliance of the judgment, failing which Director Health Service, Kashmir, shall appear in person on next date of hearing”, DB directed.
The Petitioner claims to be the owner of land measuring 01 Kanal and 08 Marlas situated at village Sholipora, Budgam and the said land was taken by the Health Department for construction of a Primary Health Centre (PHC) in the year 1988 with the promise that the son of the Petitioner will be provided employment in the Department.
It was pleaded that as no action with regard to the promise so extended by the Respondents was initiated qua providing of employment to the son of the Petitioner, compelling him to file three petitions before the Court.
