Bail denied to narco smuggler

JAMMU, Oct 25: High Court has denied bail to narco smuggler Hanief from whose possession 180 kilograms of poppy straw was recovered on February 28, 2010.
According to the police case,  on February 28, 2010 a vehicle reportedly loaded with popular bats of M/s Valley Agro Products Milk Gund, during checking by police was also found loaded with six gunny bags of poppy straw powder (bhukki) weighing 180 Kg. Police registered a case.
After hearing Advocate Rahul Sharma for the petitioner whereas AAG Seema Shekhar for the State respondent, Justice Janak Raj Kotwal observed, “the petitioner was found in possession of 180 kilograms of poppy straw which is a commercial quantity as per the relevant notification under the Act”.
“Under Section 37 of the Act, a person carrying commercial quantity of the contraband can be released on bail only if the court is satisfied that there are reasonable grounds for believing that he is not guilty of such offence and that he is not likely to commit any offence while on bail”, the court said.
Accordingly, High Court dismissed bail application with the direction to the trial court to increase its efforts for expeditious conclusion of the trial.
