DB keeps in abeyance order of Writ Court

Transfer of land for expansion of Jammu airport

JAMMU, Jan 1: Division Bench of High Court of Jammu & Kashmir and Ladakh comprising Justice Rajnesh Oswal and Justice Puneet Gupta has kept in abeyance the order of the Writ Court whereby status quo was directed to be maintained with regard to land comprising Khasra No.182 situated at Rakh Raipur, Satwari, which has already been transferred to the Airport Authority of India for extending airport.
Advocates Inderjeet Gupta and Yatin Mahajan appearing for the Senior Manager Jammu Airport submitted that land comprising Khasra No. 182 situated at Rakh Raipur, Satwari, Jammu has been transferred to the applicant/appellant by the Government and respondent (Inder Singh) had filed the writ petition without impleading the applicant as party in which he had raised grievance with regard to land comprising various Khasra Numbers including Khasra No. 182 situated at Rakh Raipur, Satwari, Jammu.
Advocate Inderjeet Gupta further submitted that the applicant/appellant was not party to the writ petition but in the contempt petition, the applicant/appellant was made one of the party as such applicant is aggrieved of the ex-parte interim order dated 03.11.2021 whereby, work of project meant for public convenience has come to halt.
“We are of the view that the applicant is aggrieved person and as such, leave is required to be granted to the applicant to file the appeal. We allow this application and the applicant is permitted to file the appeal. Application is, accordingly, disposed of. The main appeal is taken on board”, the DB said, adding “the appellant is aggrieved of the interim order dated 03.11.2021 whereby, status quo has been ordered to be maintained”.
The grievance raised by the appellant is that the land comprising Khasra No. 182 situated at Rakh Raipur, Satwari, Jammu has been transferred to the appellant and the appellant is raising construction for extending the airport meant for public convenience, the DB said, adding “normally we do not entertain the appeal against the ex-parte interim order but taking into consideration the fact that the land comprising Khasra No. 182 has been transferred to the appellant and the project of public importance is involved so, we have entertained the present appeal”.
Accordingly, the DB ordered that till next date of hearing before the Bench, order impugned so far as pertains to land comprising Khasra No. 182 situated at Rakh Raipur, Satwari, Jammu is concerned, shall remain in abeyance.
