Court frames charges against drug peddlers

JAMMU, Jan 24: The Court of Additional Sessions Judge Doda, Amarjeet Singh Langeh has framed charge against accused in case titled U.T of J&K through SHO Doda Vs. Surinder Kumar and another for offence under Section 8/15 of NDPS Act.
Allegations against two accused were that on 11.01.22 while they were travelling on a motor cycle bearing Registration No. 6282/JK14B from Thathri towards Jammu, they were intercepted by patrol party of Police Station Doda at Neeru bridge and during search nine Kilogram and 100 grams of poppy straw was recovered from them which they were allegedly carrying for sale.
After hearing Rajesh Gill, APP for U.T and counsel for accused, the Court observed, “Having considered the material available on record including statements of witnesses recorded under section 161 Cr.PC and also the report of J&K Forensic Science Laboratory and other relevant material, It is prima facie established that on 11.01.22, both accused were found carrying poppy straw in a motor cycle bearing Registration No. 6282/JK14B illegally for sale from Thathri towards Jammu and same was recovered from their possession”, adding “ There thus is prima facie evidence available on record regarding involvement of accused in the commission of offence under section 8/15 of NDPS Act for which they are charge sheeted formally”.
Accused denied charge and claimed to be tried. Prosecution was accordingly directed to lead evidence from next date of hearing onwards.
