Fast Track Court acquits rape accused

JAMMU, Feb 21: The Fast Track Court Jammu has today acquitted a rape accused of the charges leveled against him.
While delivering judgment for the case registered at Police Station Bakshi Nagar Jammu in FIR number 62/2015 under sections 376/417/506 RPC against one Varun Gupta son of Late Ved Prakash Gupta resident of Subash Nagar Jammu, Khalil Choudhary, Presiding Officer (Judge) at Fast Track Court Jammu stated that a clear room for doubt is left out in the prosecution evidence.
The Judge also said that on cumulative consideration of the matter in its totality having regard to the statements of witnesses would suggest that there is no concrete evidence on record connecting the accused with the commission of offences under section 376/417/506 RPC.
“The evidence of witnesses is not corroborative and leaves doubt in the prosecution case,” he further said.
Judge Khalil Choudhary also said that he was unhesitant to record that prosecution evidence cannot be said to definite, positive consistent and coherent so far as the case against the accused is concerned.
In his concluding remarks the Judge said: “Suspicion however, grave is no proof in the absence of reliable evidence and it is always unwise to act on mere suspicion. Thus, the prosecution case has failed and the accused Varun Gupta is accordingly acquitted of the charges leveled against him.”
