SMC cancels EC meeting after HC stay

SRINAGAR, Mar 29: Srinagar Municipal Corporation (SMC) today cancelled its Executive Committee meeting for today after the High Court stayed it.
“The Executive Committee Meeting which was scheduled to be held on 29-03-2023 at 2:00 P.M has been cancelled,” reads a copy of the order.
Notably, five incumbent councillors of SMC which include; Mukhtar Ahmad Dar, Zubair Fayaz, Umaan Maqbool Shera, Ashiq Hussain Bhat and Naima Sara had moved the petition challenging SMC’s ‘Executive Council ‘meeting before High Court on the ground that ‘tenure of the Committee has come to an end’.
Justice Sindhu Sharma stayed the impugned notice issued by the Deputy Director Planning Srinagar Municipal Corporation requesting therein the members of the Executive Committee and officers to attend the meeting today.
The agenda of the meeting was disclosed as to discuss the finalization of the works programme for the year 2023-24, cleaning of liabilities including that of IEC partners etc and other issue with the permission of chair.
The Executive Committee was also asked to submit the works proposal for action plan ahead of or during the meeting for consideration. “All such proposals should be technically vetted by the works wing, drainage wing, City Roads Division wing to equally for consideration”, reads the notice.
The notice came to be challenged by advocate Shuja-ul-Haq Tantray and submitted that the tenure of the same Executive Committee come to an end and the notice impugned could not have been called by the respondents.
He contended that the members of the Executive Committee were elected on June 19, 2021 and their tenure has already expired, therefore the vacancies had to be filled by holding of elections of councilors as per the rules.
“In the meanwhile, subject to objections and till next date of hearing before the bench, the meeting notice dated 24.3.2023 is stayed”, Court directed.
