HC restrains authorities from eviction process in Budgam

SRINAGAR, Apr 4: High Court has restrained the authorities from evicting the inhabitants from a big chunk of land situated in Budgam district.
The Inhabitants of Garind Khurd district Budgam, Kashmir have approached the court seeking the authorities not to disturb their possession and not to resort to illegal and forcible eviction to the land without following the due process of law.
Justice Sindhu Sharma after hearing the counsel Bilal Ahmad Khan at length directed that in case the eviction proceedings are initiated, the authorities shall not proceed with the same without affording an opportunity of hearing to the inhabitants.
Court directed till the inhabitants are heard, status quo as on date be maintained. The plea of the villagers of Garind Khurd is that they are in the possession of the land measuring more than 51 kanals since times immemorial.
They submit that the land has been purchased by forefathers of the petitioners and some of the land was mutated under Section 4 and 8 of Agrarian Reforms Act because the forefathers of the petitioners were cultivating the land since times immemorial.
It is submitted by the inhabitants that the official respondents despite knowing the present status of the land are trying to evict them from the land which is the main source of their shelter and is the income to the inhabitants by which they are earning their livelihood as such the eviction drive on part of the authorities is against the mandate of law and eviction would be fatal to the rights to the inhabitants.
Court has been informed that the public functionaries from Revenue have initiated the eviction process of the land under their cultivation and in possession without any intimation or serving any notice or any kind of prior information.
